We have no control over those third party apps and software, and do not make any warranties in relation to them. LIMITATION OF LIABILITY AND INDEMNITY

This Agreement is governed by the laws in QLD, Australia and the parties submit to the jurisdiction of the courts of QLD, Australia. If any part of these terms and conditions is not enforceable, it shall be severed from this Agreement and the remaining provisions will be in full force and effect. The obligations and liabilities in this Agreement survive termination. The failure to exercise our rights, or enforce a provision under this Agreement does not waive the future operation of that right or ability to enforce the provision.

OTHER

Claim means any claim, under statute, tort, contract or negligence, any demand, award or costs.
Content in our website could be any trademarks, brand names, logos, all copy, images, art, graphics, music, audio, videos, designs or any other content.
Loss or damage means any loss or damage including, but not limited to any loss of salary, loss of revenue, loss of goodwill, downtime costs, loss of profit, loss or damage to reputation, loss of data, personal injury, property damage or legal costs.
We, us, or our means Arlene Wise t/as Wisely Works [ABN 22305614614] and includes any of our employees, agents, partners and contractors.

DEFINITIONS

Licensing

Wisely Works grants the customer one nonexclusive, non-transferable, non sublicensable license. This licence permits the customer to use the website template for their own business. The customer may not resell the purchased license key provided by Wisely Works to any other parties. The customer is also not authorised to redistribute the website template(s) to any other parties (whether for financial gain or as a gift)

Proprietary Rights

Wisely Works owns the rights to all design, text, graphics, logos, trademarks you see within each template design. Photographs are the property of Unsplash or Pixabay and governed under their respective copyright licenses. Wisely Works does not grant permission or a license agreement to use the images included.

Payment

Where the option is given to you, you may make payment for the Services (the 'Services Fee') by way of third party payment processor, Stripe.

When making any payment in relation to your use of the Services, you warrant that you have read, understood and agreed to be bound by Stripes’ terms and conditions which are available on their website.

You acknowledge and agree that where a request for the payment of the Services Fee is returned or denied, for whatever reason, by your financial institution or is unpaid by you for any other reason, then you are liable for any costs, including banking fees and charges, associated with the Services Fee.

You agree and acknowledge that Wisely Works can vary the Services Fee at any time.

Payment Plans

For purchases where you choose the 2 x payment plan option, you will be billed in two separate payments over 2 consecutive months and monies will be automatically taken from your account. Please ensure that your account has sufficient funds available. Wisely Works has the right to lawfully recover outstanding monies owed.

Refund Policy

As the Service is digital, Wisely Works will not issue refunds. If the customer purchases a website template but feels it does not fit their business you may be eligible to exchange it for another template. Reach out to contact@wiselyworks.co to discuss your case but please be aware that not all requests will be fulfilled.
